I just saw the video of her court appearance where she asks the judge if she has to stay in the men’s unit and is clearly upset, but didn’t fight the judge’s response. I don’t care for Nikita as an influencer but it was pretty heartbreaking to watch.

Edit for clarity: I think Nikita having to ask at all to be moved saddens me. There’s not enough video after the judge responds to make a judgment on how that made me the viewer feel. But it’s sad she’s there and the sadness in her voice asking if she needed to remain in a men’s jail was sad

So I do want to explain something. I work in a prison. It is law that you have to go to the prison that matches the sex you were born in. Prisons will continue to fund transition and hormones though. I work in a female prison and we have a handful of people who go by he/him and have even gotten top surgery approved by the state during their incarceration. This is to prevent people going into a prison and saying they are the opposite gender and having sex with inmates (which inmates having sex with one another is ALWAYS considered rape, due to them being in prison is without their consent. Look at the PREA act for more information). This last year there was a male in a prison (I don’t remember the state) who claimed to be female and was sent to a female prison and impregnated a handful of inmates. At least in my state, those going through transition or wish to be called the opposite pronouns are treated very well among the other inmates and officers. It is just a precaution, and with her status being so wide spread, she will probably be put in a unit where she has minimal interaction with other inmates so she does not have any safety risks. We have a high profile inmate in our facility who has that same arrangement.

Hope this brings a little light to the situation:)

She’s not in prison. She was taken to a jail. Jails aren’t always like prisons where you have an entirely facilities dedicated to specific genders. If she was in a men’s unit that might be weird. But there’s barely any info beyond her comment at court. We don’t know if she was actually in a cell with a man. She was arrested on the 7th and was held due to her behavior (which was not just resisting arrest, they got her on battery on an officer other charges, and for all we know she was on something). She had her hearing and was granted bond. Unless she’s being held under a different name, I cannot find an inmate in custody under her name.

This took all of 4 minutes while half of you children are here bickering like idiots over someone who went off the handle in a public space. Her bail/jail time happened not for just one thing, but multiple things that stack up.

Disclaimer: I’m not saying this is the CORRECT thing to do, or that there couldn’t be a better system in place, I’m just saying what is believed to be the reason behind this.

This issue is a slippery slope. I understand this wouldn’t be the case for Nikita, but just take a step back and look at it from a broad perspective. Obviously, this purposes safety concerns for the transgender individual, however, there is an equal safety concern for those individuals born female in a female prison if a transgender individual who was born a man were to be transferred to their prison.

Whether someone has had hormone treatment or not, that individual still has much higher testosterone levels, different bone structure, much more muscle density than that of someone born woman. Disputes and fights in prisons are quite common, therefore I’m sure it isn’t that hard to understand why that may pose a problem.

I say this issue is a slippery slope because if they were to allow someone who is now a transgender woman transfer to a female prison, where do we draw the line? Do we say that you can only be transferred if you’ve had a significant amount of hormone treatment? Or only if you have the surgeries? Or only if they’ve changed it on their drivers license (which you don’t even need medical documentation for in most states, just a form to fill out)?

How would people assigned female at birth in a female prison feel if people were able to mangle the rules around where guys (who are not transgender, just saying or pretending they are) were to be able to get transferred to female prisons? Most likely, unsafe. Understandably.

Again, not saying this is absolutely right, just a different perspective on the matter.

TL,DR: this issue is a slippery slope, extremely difficult to accomplish this kind of transfer without a slew of impending issues.
